It is absolutely free to enter as many stories in as many Fiction and/or Non-Fiction genres as you please. By submitting a story to World’s Best Story, authors retain all rights to their stories.

World’s Best Story Writing Contest

OFFICIAL RULES

Please read these Official Rules before entering the World’s Best Story Writing Contest (“Contest”). By submitting an entry, entrants (and their parents or legal guardians if the entrant is under 18 or a minor in the jurisdiction in which that entrant resides) (“you” or “your”) acknowledge that you are eligible to enter the Contest and have read and agree to be bound by these Official Rules and our and the judges decisions related to the Contest. This year we will select one “Grand Prize” winner for the Contest along with nine finalist from a top 10 list. Details of the Grand Prize and other Contest prizes are described more fully below. The “Sponsor” of the Contest is World’s Best Story.

1. ELIGIBILITY

You are eligible to enter the Contest if you are at least 13 years old at time of entry. Open to people from all over the globe who are age of majority in the province or territory of residence at time of entry. The Contest and these Official Rules are void where prohibited by law, and are subject to applicable laws. Entrants may not be members of any guild, union or other organization that may prohibit them from participating in this Contest and that would restrict, require due payment or otherwise have the right to oppose such entrant’s participation in this Contest. If you are considered a minor in your jurisdiction, you must have the permission of a parent (or both parents where required by law) or legal guardian to enter the Contest. If you are not of the legal majority in the jurisdiction in which you reside, your parent or legal guardian will be responsible for fulfilling all of the requirements set forth in these Official Rules. You are not eligible to enter the Contest if you are (a) a family member (spouses, domestic partners, parents, grandparents, siblings, children, and grandchildren) of the contest Sponsor.

2. HOW TO ENTER

Each Entry must include one of the following genre selections and will be categorized accordingly for judging throughout the Contest:

  • Adult
  • General Fiction
  • Mystery/Thriller
  • Science Fiction/Fantasy
  • Horror
  • Romance
  • Young Adult Fiction
  • Action/Adventure
  • Non Fiction
  • Children

You must register at worldsbeststory.com to enter the Contest. Once you have registered, follow the instructions on the entry form and upload: (1) a sample chapter of up to 5,000 words, but not less than 3,000 words, of your Manuscript (“Excerpt”); (2) a synopsis of your Manuscript consisting of up to 300 words (“Synopsis”); (3) the Title; (4) any personal information required on the entry form. (1-4 collectively, an “Entry”). We will not review any Entry that does not comply with these Official Rules.

3. ENTRY REQUIREMENTS

You must be the only author of your Manuscript, and your Manuscript must be a novel between 50,000 and 125,000 words. Any Manuscript submitted as an Entry written by two or more authors will not be eligible. Additionally, poems, short stories, and collections of works are not eligible. Your Title, Manuscript, Excerpt, and Synopsis must: (a) be your original creation; (b) be fictional or non-fiction; (c) be in the English language; (d) be of interior black and white text without images; (e) not currently or previously have been the subject of a publishing agreement or option with any publisher (but you may submit your self-published novel if you retain all worldwide distribution rights in and to the novel) in any format, including audio, digital, and print formats; (f) not include your real or pen name anywhere in the Manuscript, Excerpt, or the Synopsis; (g) not include any information that identifies the author in any way including, but not limited to, a resume, previous awards received for the work, or the identity of additional works by the author, but excluding any file document properties that may identify the author. Additionally, you must submit your Manuscript digitally in Microsoft Word .doc, .docx, .rtf, or .txt format. Any Entry that we determine, in our sole discretion, to meet these requirements will be considered a “Valid Entry.” You may be represented by an agent on the condition that you – not your agent – agree to comply with these Official Rules. Sponsor computers, servers and clock will be the official clock for all phases of the Contest, and your proof of submission is not proof that we received your Entry. You may only submit one Entry per category. If you submit more than one Entry, the first Entry that we receive will be the judged Entry, and any subsequent Entries you submit will be void and disregarded. We reserve the right, in our sole discretion, to disqualify your Entry from the Contest if the Entry (x) contains obscene, offensive, pornographic or sexually explicit material, (y) is libelous, disparaging, includes inappropriate content, or (z) does not comply with these Official Rules.

4. CONDITIONS OF ENTRY

By submitting an Entry, you represent and warrant that your Entry: (a) is your original creation; (b) has not been copied in whole or in part from any other work; (c) has not previously been published as described in Section 3 (e) above; (d) does not violate or infringe any copyright, trademark, privacy or publicity right, or other proprietary or intellectual property right of any person or entity; (e) is not defamatory, libelous, obscene, does not contain any material that promotes bigotry, racism, hatred or harm against any group or individual or promotes discrimination based on race, gender, religion, nationality, disability, sexual orientation or age, or otherwise illegal; and (f) is your sole and exclusive property. You further represent and warrant that you have complete, worldwide distribution rights in and to your Title, Manuscript, Excerpt, and Synopsis.

5. GRANT OF RIGHTS

By submitting an Entry, you grant us and our respective affiliates and agents permission to use, without charge, portions of your Manuscript, Synopsis, or Excerpt, along with your name and stated reason for writing the submitted Entry (if provided) for any purpose in connection with this Contest. You also grant us the right to edit the formatting and display of your Entry, and to create literary or any other types of effects in respect to your Entry without compensation or approval. In addition, to the extent that any moral rights (for example, the right to attribution and the right to integrity) apply, you waive (and to the extent that these rights may not be waived, agree irrevocably not to assert) your moral rights in your Entry for purposes of this Contest, including, without limitation, our use of excerpts from your Entry in connection with this Contest. You represent that you have received the consent of any person (or parent or legal guardian if such person is a minor) whose real and actual name or likeness is used or featured in any Entry that you submit. If you fail to obtain the consent, your Entry will be disqualified. We have the right at any time during the Contest to request proof of consent, and to disqualify your Entry if you cannot provide the requested proof. Excerpts, along with the your name, city, and state of residence, and portions of your Entry which relate to the submitted Manuscript, may be posted on any website owned or operated by us or any of their affiliates (“Our Site”), any other website or other online point of presence on any platform through which any products or services available on or through Our Site are described, syndicated, offered, merchandised, or advertised. Our decision to post an Excerpt or any portion of an Entry on any one of Our Sites does not mean that the selected Entry has been selected as a winning Entry.

6. COLLECTION/USE OF PERSONAL INFORMATION

We are collecting personal information primarily to process Entries, to contact you if necessary, or for marketing and other purposes. By participating in this Contest, non-Canadian resident entrants are authorizing the transfer of personal data to Canada for these purposes. If you do not wish to be contacted for marketing purposes, you will be provided with a method to opt-out from future communications. If you would like to access or modify your information related to this Contest in our database, please send an e-mail to info@parmes.co. By entering the Contest, you agree that we may share your information, in our sole discretion, with third parties that have a need to know the information, such as the judging panel or third parties that we retain to assist in administering the Contest; however, those third parties may only use the information for purposes related to this Contest. The data controller is World’s Best Story. Please do not submit an entry if you do not agree to these terms or to the privacy notice available at https://worldsbeststory.com/privacy

7. CONTEST JUDGING PROCESS

A. Submission Period

The World’s Best Story platform accepts story submissions 365 days a year including non-contest periods.

Each Entry must include one of the following eligible genre selections (“Genres”) and will be categorized accordingly for judging throughout the Contest:

  • Adult
  • General Fiction
  • Mystery/Thriller
  • Science Fiction/Fantasy
  • Horror
  • Romance
  • Young Adult Fiction
  • Action/Adventure
  • Non Fiction
  • Children

B. VotingWorld’s Best Story members that are non-contestants (“Readers”) will read and rate the Title, Synopsis and Excerpt for each Valid Entry in any Genre using the voting mechanics available at www.worldsbeststory.com.

World’s Best Story members that are non-contestants (“Readers”) will read and rate the Title, Synopsis and Excerpt for each Valid Entry in any Genre using the voting mechanics available at worldsbeststory.com.

Contest Readers will be asked to answer the following question: “On a scale of zero to one hundred percent (0% -100%) how would you rate this story’s potential success in the following media formats?”:

  • Merchandise

C. The Top 10 list will be announced by email alert, newsletter, social networks, and on worldsbeststory.com

The top 10 finalists will be used to determine final ranking and identify who will win the World’s Best Story contest.

Stories will be evaluated on a 100 point scale. Entries will be given a score of 0% to 100% for each of the following elements:
PREMISE/CONCEPT
The idea behind the story — What’s the story about? What’s the “hook”?
PRESENTATION
Did the author fulfill contest specifications and fulfill basic grammatical and spelling standards? — font, correct margins, spelling, punctuation, grammar, and usage.
STRUCTURE
What’s the framework of the story? Was there effective use of three-act, odyssey, linear or non-linear story progression. Did the author otherwise innovate?
PLOT
Did the actions, events, conflicts, and turning points effectively propel the story forward? How did the story unfolds (points for originality/unpredictability)?
PACING
How was the timing of the action, unfolding of plot elements and character development?
CHARACTERS
Were the personalities distinctive, compelling, multi-layered, and unpredictable. Did the protagonist and antagonist have clear and active goals?
DIALOGUE
Were the voices natural, succinct, and unique to each character.? Did the author’s use of language effectively reveal character and move the story forward.
THEME
Did the author convey a clear underlying message of the story as revealed through plot, dialogue, and visual elements?
STYLE/TONE
How was the overall quality of the writing?
COMMERCIAL POTENTIAL
How would you rate mass audience appeal and box-office potential for this story? Is this story a blockbuster? On a scale of 0% to 100%, how would you rate this story’s potential success in the following media formats?:

If a tiebreaker is needed to determine the winner, the following methods will be used:

1st tiebreaker: Highest Overall Strength of Submission score

2nd tiebreaker: Highest Prose/Style score

3rd tiebreaker: Highest Plot score

4th tiebreaker: Highest Character Development score

5th tiebreaker: Highest Originality of Idea score

6th tiebreaker: Sponsor editorial decision
The Sponsor will announce the final top 10 ranking and Winner at www.worldsbeststory.com.

8. PRIZES

A PUBLISHING DEAL WITH WBS ENTERTAINMENT
$10,000 IN BOOK MARKETING/PROMOTION INCLUDING PROFESSIONAL COVER AND EDITING
REPRESENTATION OF YOUR STORY FOR OPTIONING OPPORTUNITIES TO THE ENTERTAINMENT INDUSTRY (e.g. VIDEO GAME, TV/MOVIE, MUSICAL, ETC…) and negotiate the best terms for you.

As Winner of the World’s Best Story contest, you may not negotiate the publishing contract with World’s Best Story, and you must sign it “as is” upon receipt of the executable contract (as described in Section 11 below) if you wish to enter into the publishing contract being awarded.

The publishing contract will be governed by the laws of the Province of Quebec, Canada

E. General. Each of the top ten winners may be required to provide any additional tax filing information as requested by Sponsor. You are responsible for ensuring that the tax documentation submitted to us complies with all applicable tax laws and requirements. If you fail to provide the documentation or submit incomplete documentation, the prize may be forfeited and we may, in our sole discretion, select an alternate. You may not substitute, transfer or redeem your prize for cash. We reserve the right to substitute a prize (or portion of a prize) with anything of comparable or greater value. We award all prizes “as is” and without warranty of any kind, express or implied, including, without limitation, any implied warranty of merchantability or fitness for a particular purpose.

9. DISQUALIFICATIONS

If your Entry is disqualified for any reason, you will not receive a notice or explanation describing the reason for the disqualification.

10. FINALIST NOTIFICATION AND REQUIREMENTS

If you are selected as Winner of the World’s Best Story, we will notify you by phone or e-mail. You will be required to sign and return an Affidavit of Eligibility, Liability/Publicity Release & Nondisclosure Agreement (“Affidavit and Release”). If you do not return the required documents to us by the specified dates, you will be disqualified from the Contest.

If any documentation is not returned by the specified dates, we may invite an alternate Finalist, chosen by the Professional judging panel from among the Top 10 finalists in the same manner as described above to replace the Top 10 Finalist. If notification to the alternate Finalist is returned as undeliverable, we may invite the next eligible alternate Finalist from among the Top 10 Finalists, and so on. If you are under 18 or a minor in the jurisdiction in which you reside at the time a prize is awarded, the prize will be awarded to you only after the your parent or legal guardian signs the Affidavit and Release and any other documentation that may be required for you to claim a prize. We will notify prize recipients of all other prizes by e-mail or phone. Prior to awarding a prize, we may require you to sign additional documents we believe are necessary to confirm your eligibility, to obtain a liability and publicity release, and to award any prize.

11. ADDITIONAL TERMS

The Contest and all accompanying materials are © 2017 by World’s Best Story. All rights reserved. The Contest is void outside the eligible entry jurisdictions and where prohibited by law. You agree that our decisions related to the Contest are final and binding in all matters. We reserve the right, to the maximum extent permitted by law, in our sole discretion, to change these rules or cancel the Contest at any time. We may also modify, terminate or suspend the Contest if any viruses, worms, bugs, unauthorized human intervention, or other causes beyond our control corrupt or impair the administration, security, or fairness of the Contest or submission of Entries. If you use the name or likeness of an individual in your Entry, you agree to be solely responsible for that use. You agree that we, the Sponsor, affiliates, subsidiaries and advertising and promotion agencies, along with any officers, directors, agents, employees and representatives of any of them (collectively, “Released Parties”), will not be responsible for any action brought by a person whose consent you did not obtain. The Released Parties are not responsible for: (a) any human or other error that may occur in the processing of the Entries; (b) any error, omission, interruption, deletion, defect, delay in operation or transmission, theft or destruction, or unauthorized access to or alteration of Entries; (c) or for technical, network, telephone, computer, hardware or software, malfunctions of any kind, which may occur in connection with this Contest, including, without limitation, any errors or problems related to the administration of the Contest, the processing or judging of Entries, the tabulation of votes, the announcement of the prizes, or the Contest-related materials. Released Parties are also not responsible for: (y) inaccurate transmission of, or failure to receive, any entry information on account of technical problems or traffic congestion on the Internet or at any Web site; and (z) injury or damage to you or any other computer resulting from downloading any materials in connection with the Contest. We reserve the right, in our sole discretion, to disqualify any individual found to be tampering with the entry or voting process, the outcome of the Contest, or the operation of the Contest or Web site; to be acting in violation of these Official Rules; or to be acting in an unsportsmanlike or disruptive manner or with intent to annoy, abuse, threaten, or harass any other person (including actions by you on our message boards) and void all associated Entries. ANY ATTEMPT BY ANY INDIVIDUAL TO DELIBERATELY DAMAGE ANY WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE CONTEST MAY BE A VIOLATION OF CRIMINAL AND CIVIL LAWS, AND IF SUCH AN ATTEMPT IS MADE, WE RESERVE THE RIGHT TO SEEK DAMAGES OR OTHER RELIEF (INCLUDING ATTORNEYS’ FEES) FROM THE PERSON TO THE FULLEST EXTENT PERMITTED BY LAW.

12. LIMITATIONS OF LIABILITY

THE RELEASED PARTIES ARE NOT RESPONSIBLE FOR THE UNAUTHORIZED USE OF ANY ENTRY (OR ANY PORTION OF ANY ENTRY) BY ANY THIRD PARTY. YOU AGREE (FOR YOURSELF AND YOUR HEIRS) THAT THE RELEASED PARTIES, TO THE MAXIMUM EXTENT PERMITTED BY LAW, ARE NOT RESPONSIBLE FOR ANY LIABILITY, LOSS, INJURY, OR DAMAGE TO PROPERTY OR TO PERSON. YOU ALSO AGREE THAT WE ARE NOT RESPONSIBLE FOR ANY REASONABLE ATTORNEY’S FEES AND COURT COSTS DIRECTLY OR INDIRECTLY RELATED TO YOUR PARTICIPATION IN THE CONTEST, OR BY REASON OF YOUR ACCEPTANCE, POSSESSION, USE OR MISUSE OF THE PRIZES (INCLUDING ANY TRAVEL OR ACTIVITY RELATED TO A PRIZE). NOTHING IN THESE OFFICIAL RULES WILL LIMIT ANY RELEASED PARTY’S LIABILITY FOR DEATH OR PERSONAL INJURY CAUSED BY THAT PARTY’S NEGLIGENCE, A BREACH OF THESE OFFICIAL RULES, OR FRAUDULENT MISREPRESENTATION.

13. GOVERNING LAW/DISPUTES

This Contest is governed by the laws of Canada and the Province of Quebec. As a condition of participating in this Contest, you agree, to the extent permitted by law, that any and all disputes which cannot be resolved between the parties, and causes of action arising out of or in connection with this Contest, will be resolved individually, without resort to any form of class action, exclusively before a court located in Quebec, Canada. FURTHER, IN ANY DISPUTE, UNDER NO CIRCUMSTANCES WILL YOU BE PERMITTED TO OBTAIN AWARDS FOR, AND YOU HEREBY WAIVE ALL RIGHTS TO CLAIM, PUNITIVE, INCIDENTAL OR CONSEQUENTIAL DAMAGES, INCLUDING ATTORNEYS’ FEES, OTHER THAN ENTRANT’S ACTUAL OUT-OF-POCKET EXPENSES (E.G. COSTS ASSOCIATED WITH ENTERING). YOU FURTHER WAIVE ALL RIGHTS TO HAVE DAMAGES MULTIPLIED OR INCREASED.

14. RIGHTS OF PUBLICITY

By participating in the Contest, you consent to the worldwide use of your name, biographical information, photographs, videos or likenesses in any manner and in any medium now in existence or later invented for any purpose in connection with the Contest without additional compensation, notification or permission, except where prohibited by law.

WBS READER RULES — RANDOM DRAW CONTEST RULES

A- SHORT RULES

World’s Best Story

No purchase required. Open to legal residents of the U.S., Britain, the Republic of Ireland, Australia, New Zealand, South Africa, and Canada who are age of majority in the province or territory of residence at time of entry. B- LONG RULES

NO PURCHASE OF ANY KIND IS NECESSARY TO ENTER OR WIN.

1. SPONSOR

The World’s Best Story contest (the “Contest”) is sponsored by WBS Entertainment Co., 1822 Sherbrooke Street West, suite 100, Montreal, QC, CANADA H3H 1E4 (the “Sponsor”).

2. ELIGIBILITY

The Contest is open to readers and writers who are legal residents of the U.S., Britain, the Republic of Ireland, Australia, New Zealand, South Africa, and Canada who have reached the age of majority in their province or territory of residence at the time of entry, with the exception of employees of the Sponsor, its parent, related and affiliated companies, subsidiaries, departments or agencies, franchisees, suppliers, advertising and promotional agencies, contest administrators, and any other parties engaged in the development, production or distribution of Contest materials and those living in the same household. By participating in this Contest, registered Readers acknowledge compliance with, and agree to be bound by, these Contest Rules. Registered Readers who do not comply with any of the Contest Rules are subject to disqualification by the Sponsor, in the Sponsor’s sole discretion.

3. HOW TO REGISTER

Readers can register and receive rewards by filling out and submitting a registration form on https://worldsbeststory.dev/sign-up. For this Contest receipt of an Internet entry occurs when Sponsor’s servers record the entry information. All reader registrations must contain a complete first and last name, telephone number, postal code and e-mail address to be a valid entry and are subject to verification by the Sponsor in its sole discretion. Limit one entry per person/e-mail address.

Any attempt or suspected attempt to use robotic, automatic, programmed, or otherwise, illicit means to enter the Contest, or any other methods not authorized by these Contest Rules, for example, but not limited to, creating multiple accounts, identities, or registrations, all in the Sponsor’s sole discretion, shall be deemed as tampering and may disqualify you from entering, participating and/or winning a prize. Entry forms that contain false or incomplete information are void. Entries that are late, lost, stolen, illegible, contain false information, are damaged, misdirected, mutilated, garbled or incomplete, altered or otherwise irregular or that do not conform with or satisfy any or all of the conditions of the Contest Rules are void. Entrants grant Sponsor a non-exclusive license to use all entries for any purpose. No correspondence will be entered into except with selected entrants. Proof of transmission (screenshots or captures, etc.) does not constitute proof of entry or receipt of an entry.

4. CONTEST PERIODS AND REWARDABLE ACTIONS

A. Reader registration throughout submission period

Each Entry will include one of the following eligible genre selections (“Genres”) and will be categorized accordingly for judging throughout the Contest:

WBS Readers who register for rewards during this period will be awarded one ticket for a monthly raffle. Prizes and rewards will be featured on www.worldsbeststory.com

B. Voting

WBS Readers will read and rate the Title, Synopsis and Excerpt for each Valid Entry in any Genre using the voting mechanics available at www.worldsbeststory.com. This rating will focus on an average score that will be ranked with all other Contestant scores and provide the Sponsor and Contest Readers with a top 10 leaderboard.

Readers will receive one ticket for every Contestant rating in Round Two. Each ticket is a chance to win sponsored goods from monthly draws. These prizes are posted on www.worldsbeststory.com

Contest Readers will be asked to answer the following question: “On a scale of 0% to 100% how would you rate this story’s blockbuster potential success in the following media formats?”:

  • Print Book
  • E-book
  • Audio Book
  • Application/Enhanced e-book
  • Video game
  • Web Series
  • TV show
  • Film
  • Musical
  • Merchandise

Readers will have the opportunity to make this blockbuster potential rating for all available contestants. Readers will receive one ticket for every Contestant rating eligible for the monthly draw. Prizes posted on www.worldsbeststory.com.

The Top 10 list will be announced by email alert, newsletter, and on www.worldsbeststory.com

The combination of the public and professional votes will determine final ranking and identify who will win the 2016 World’s Best Story contest.

Professional judging include the reading of 10 full finalist manuscripts, only one of which will be selected to advance to the status of grand prize winner of the 2016 World’s Best Story.

Readers will receive one ticket for every Contestant rating for the Reader’s Grand Prize. Details are posted on www.worldsbeststory.com

5. CONTEST PRIZES

All winners assume any and all liability for any injury or damage caused, or claimed to be caused, by entering, participating in this promotion or use or redemption of a prize. Prizes must be accepted as awarded and have no cash value. Prizes or any portion thereof cannot be combined with other discounts, promotions or special offers. Sponsor reserves the right to substitute an alternate prize of equal or greater value if an advertised prize is unavailable at time of award.

6. ODDS OF WINNING

The odds of winning depend on the number of eligible entries received before the Contest End Date.

6. SKILL TESTING QUESTION

The Selected Entrant will be required, as a condition to winning the Prize, to correctly answer, without assistance of any kind, whether mechanical or otherwise, or being presented in advance, the Sponsor’s time-limited, mathematical skill-testing question to be administered during a pre-arranged telephone call.

7. WINNER SELECTION AND CONFIRMATION

The Selected Entrant will be deemed a winner if they meet all of the eligibility criteria set out in these Contest Rules. If a Selected Entrant does not meet the eligibility criteria, he/she will be disqualified and will not receive a prize and another entrant will be selected by way of a random draw from the remaining eligible entries. Before being declared a winner, a Selected Entrant will be required to: (i) correctly answer a skill-testing question; (ii) sign and return the Sponsor’s Declaration of Eligibility and Liability/Publicity Release form; and (iii) comply with all other Contest Rules, all in the sole discretion of Sponsor.

The Selected Entrant will be notified by e-mail or telephone within one (1) business day of the draw. The Selected Entrant will be contacted using the e-mail address or telephone number provided at the time of entry into the Contest and up to three attempts will be made within 36 hours following the draw. A Selected Entrant that does not or cannot accept the Prize may be forfeited and a new Selected Entrant selected by random draw, in the Sponsor’s sole discretion. Signed release form must be received by the Sponsor no later than two weeks after being contacted. The Sponsor is not responsible for the failure for any reason whatsoever of a Selected Entrant to receive notification or for the Sponsor to receive a Selected Entrant’s response.

Disputes regarding identity of entrant: If the identity of a Selected Entrant is disputed, the entry will be deemed to have been submitted by the Authorized Account Holder (the individual assigned to the e-mail address for the domain associated with the submitted e-mail address). Each Selected Entrant may be required to provide proof that he/she is the Authorized Account Holder of the e-mail address associated with the selected entry.

8. RELEASE AND INDEMNIFICATION

The winner must sign the Sponsor’s Declaration of Eligibility and Liability/Publicity Release form to: (i) confirm compliance with the Contest Rules; (ii) agree to accept the prize as awarded; (iii) release, discharge and hold harmless the Sponsor, its departments and agencies, parent, related and affiliated companies, subsidiaries, franchisees, advertising and promotional agencies, counsel, marketing partners, Facebook and each of their respective directors, officers, employees, shareholders, successors, sponsors, partners, licensees, subsidiaries, agents, artists, advisors, assignees, and all others associated with the administration, development and execution of the Contest (the “Released Parties”) from and against any and all manner of action, cause of action, claim or demand, loss or injury, use or misuse of a prize or any travel related thereto, and the use of the Entry by the Sponsor, suit, debt, covenant, contract, including legal fees and expenses, whatsoever, including but not limited to, claims based on negligence, breach of contract and fundamental breach, failure of any third party contractor or supplier used in connection with any aspect of the Contest to perform or deliver any goods or services, any act of God or any other event beyond the Released Parties’ control, any dissatisfaction of any kind by a winner with any aspect of the Contest or any prize, liability for physical injury, death, or property damage which the entrants, guests, their heirs, successors or assigns have, might have or could have suffered, by reason of or arising out of the entrant’s participation in the Contest and/or in connection with the acceptance and/or exercise by the entrant of the Prize as awarded; and (iv) indemnify the Released Parties against any loss, damage or expense, including legal fees, that any of the Released Parties may suffer or incur as a result of any non-compliance by an entrant with any of the Contest Rules or participation in the Contest and/or in connection with the acceptance and/or exercise by an entrant of a prize and the use of the Entry by Sponsor.

The Sponsor is not responsible for: (i) incorrect or inaccurate entry information which may affect a person’s ability to participate in the Contest or be awarded a prize, including but not limited to human error, technical malfunctions, lost or delayed entries for any reason, mail failures, omission, or any combination thereof, and entries which fail to fully comply with these Contest Rules; (ii) technical failures of any kind, including, but not limited to malfunctions, interruptions, or disconnections in phone lines or network hardware or software; (iii) lost, incomplete, delayed, mutilated or misdirected entries or Declaration and Release forms; (iv) injury or damage to the entrant’s computer or to any other individual’s computer related to or resulting from participating in, or downloading any material regarding the Contest or accepting a prize; (v) any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from entrant’s participation in the Contest or receipt or use or misuse of any prize, including any travel related thereto and the use of the Entry by Sponsor; (vi) the security or privacy of information transmitted via computer networks or for breaches of privacy due to interference by third party computer “hackers” or otherwise; or (vii) late, lost, misdirected or unsuccessful efforts to notify a potential winner.

9. OTHER CONDITIONS

The Sponsor reserves the right, subject to the approval of the Régie des alcools des courses et des jeux (“RACJ”), to terminate or amend this Contest at any time and in any way, without prior notice. Without limiting the foregoing, if, for any reason, the Contest is not capable of running as originally planned for any reason, the Sponsor reserves the right, subject to the approval of the RACJ, to cancel the Contest and conduct a random draw from all previously received eligible entries received by the Contest End Date.

10. OTHER CONDITIONS

The Sponsor reserves the right to terminate or amend this Contest at any time and in any way, without prior notice. Without limiting the foregoing, if, for any reason, the Contest is not capable of running as originally planned for any reason, the Sponsor reserves the right to cancel the Contest and conduct a random draw from all previously received eligible entries received by the Contest End Date.

Publicity and entrant information: By participating in the Contest, entrants consent to the use of their name, address, postal code, e-mail address, telephone number, social media handles, comments and image, whether on videotape, photograph or any other means, for the administration of this Contest or any publicity carried out by the Sponsor, without further notice or compensation. Any and all information provided for this Contest by entrants is provided to the Sponsor not Facebook.

Law: The Contest is void where prohibited by law and is subject to all applicable Canadian federal, provincial, territorial, municipal and local laws. For residents of Quebec, any litigation respecting the conduct or organization of a publicity contest may be submitted to the RACJ for a ruling. Any litigation respecting the awarding of a prize may be submitted to the RACJ only for the purpose of helping the parties reach a settlement. For residents of all other jurisdictions, this Contest shall be governed exclusively by the laws of the province of Quebec, including all issues and questions concerning the construction, validity, interpretation and enforceability of these Contest Rules, rights and obligations between entrants and the Sponsor, and procedural provisions, without giving effect to any choice of law or conflict of law rules. Any dispute shall be adjudicated by the courts sitting in Montreal, Quebec.

Rule amendments: The Sponsor reserves the right, in its sole discretion, to amend or modify these Contest Rules, or modify, cancel or suspend this Contest, without prior notice for any reason whatsoever, including without limitation in the event that any cause beyond the reasonable control of the Sponsor corrupts, or threatens to corrupt, the security or proper administration of the Contest.

Intellectual Property: All intellectual property, including but not limited to trademarks, logos, designs, promotional materials, web pages, source codes, images, drawings, illustrations, slogans and representations are owned by the Sponsor. All rights are reserved. Unauthorized copying or use of any copyrighted material or other intellectual property without the express written consent of the Sponsor is strictly prohibited. The Sponsor’s marketing or other partners, if any, shall also have access to and rights to reproduce, copy or otherwise use any materials generated by this Contest or any submissions or materials generated by entrants.
